GENERAL TERMS AND CONDITIONS OF BUSINESS


INTRODUCTORY PROVISIONS


These General Terms and Conditions govern the procedure for ordering, paying, delivering and returning products, as well as the rights and obligations of the contracting parties arising from purchases via the web shop of Wisdom Consulting doo, Ulica Andrije Kačića Miošića 41, 10410 Velika Gorica, OIB: 74176380636, MBS: 081504810, entered in the court register of the Commercial Court in Zagreb, VAT ID: HR74176380636 (hereinafter: "Seller", "we", "our webshop").

By using our website and ordering products, you confirm that you are familiar with these terms, that you fully accept them, and that you agree to their application.

The Seller reserves the right to change these terms and conditions at any time without prior notice. The current version of the terms and conditions is always available on the webshop page and applies to all purchases made after the date of publication.

CUSTOMERS AND TERMS OF USE


The buyer can be any adult and legally capable natural person who accepts these terms. Using the webshop for malicious purposes, as well as purchasing for resale without the consent of the seller, is not permitted.

The webshop is available 24 hours a day, 7 days a week. The seller is not responsible for any unavailability of the site due to technical or other reasons.

PURCHASE PROCEDURE


Ordering products is done via the online shopping cart. After adding the desired items and entering the required data, the buyer confirms the order. The system automatically generates an order confirmation that the buyer receives by e-mail. The contract is concluded when the seller confirms the shipment of the product.

PRICES AND PAYMENT METHODS


All prices are shown in euros (EUR) and include VAT. The seller uses the Shopify payment system.

Possible payment methods:

  • Debit and credit cards (Visa, Mastercard, Maestro, Diners, American Express)
  • Apple Pay
  • Google Pay
  • Shopify Payments

Shipping costs, as well as additional bank charges, are not included in the product price and are charged separately at checkout.

PREDNARUDŽBE


Definicija prednarudžbe

Prednarudžba (engl. preorder) predstavlja kupnju proizvoda koji u trenutku narudžbe nije dostupan na skladištu, već će biti dostupan u budućnosti, nakon službenog datuma izlaska koji određuje proizvođač ili distributer.

Način naručivanja

Kupac može izvršiti prednarudžbu putem standardnog procesa kupovine putem webshopa. Svi proizvodi koji se prodaju putem prednarudžbe jasno su označeni kao prednarudžba ili preorder u opisu proizvoda. U opisu proizvoda naznačen je i procijenjeni datum isporuke ili procijenjeni datum izlaska proizvoda, koji može biti podložan promjenama od strane dobavljača ili proizvođača.

Plaćanje prednarudžbi

Sve prednarudžbe plaćaju se unaprijed u cijelosti, osim ako nije drugačije navedeno. Plaćanjem prednarudžbe kupac osigurava svoju rezervaciju proizvoda.

Isporuka prednaručenih proizvoda

Prednaručeni proizvodi bit će otpremljeni čim postanu dostupni u našem skladištu. Isporuka ovisi o službenom datumu izlaska proizvoda i/ili o vremenu isporuke od strane naših dobavljača.

U slučaju kašnjenja isporuke, kupac će biti pravovremeno obaviješten putem e-maila. POKEDOM nije odgovoran za kašnjenja koja su izvan naše kontrole (npr. promjena datuma izlaska od strane proizvođača ili kašnjenja u transportu).

9.5 Kombiniranje narudžbi

Ako kupac u istoj narudžbi kupi proizvode dostupne odmah i proizvode u prednarudžbi, cjelokupna narudžba bit će poslana kada svi proizvodi budu dostupni.

Ako kupac želi raniju isporuku dostupnih proizvoda, molimo da ih naruči odvojeno.

Otkazivanje prednarudžbi

Kupac može otkazati prednarudžbu sve do trenutka kada proizvod bude otpremljen. U slučaju otkazivanja, moguće je ostvariti povrat sredstava, umanjen za transakcijske troškove, ako postoje (ovisno o načinu plaćanja).

Povrat sredstava

Povrat sredstava vrši se isključivo putem istog načina plaćanja koji je korišten prilikom kupnje. Nakon što je povrat odobren i obrađen, može proći između 5 do 10 radnih dana da sredstva budu vidljiva na računu kupca, ovisno o banci ili pružatelju usluge plaćanja.

Prodavatelj ne snosi odgovornost za eventualna dodatna kašnjenja koja su uzrokovana obradom povrata od strane trećih strana (npr. banaka, kartičarskih kuća ili platnih servisa poput PayPal-a).


POKEDOM zadržava pravo otkazivanja prednarudžbe i izvršenja povrata sredstava kupcu u slučaju:

  • ako proizvod ne postane dostupan;
  • ako dođe do greške u sustavu (npr. pogrešna cijena, pogrešan opis);
  • ako dobavljač otkaže ili značajno odgodi isporuku.

Povrati i reklamacije za prednarudžbe

Kupac ima pravo na povrat ili zamjenu proizvoda iz prednarudžbe u skladu s našim pravilima o povratu i reklamaciji, počevši od dana kada proizvod zaprimi.

Ako je proizvod oštećen, neispravan ili ne odgovara opisu, primjenjuju se ista pravila kao i za redovne proizvode.

Zlouporaba prednarudžbi i povrata sredstava

Neopravdani zahtjevi za povrat sredstava putem banke (chargeback) za proizvode koji su jasno označeni kao prednarudžba i još nisu imali rok za isporuku, mogu se smatrati kršenjem Općih uvjeta poslovanja. U takvim slučajevima, POKEDOM pridržava pravo poduzimanja pravnih mjera za nadoknadu nastale štete.

DELIVERY


We deliver in the territory of the Republic of Croatia and the European Union via courier services. The delivery time for HR is 1–3 working days, while for the EU it depends on the country of delivery, usually 3–7 working days.

In the event of unsuccessful delivery due to incorrect information or the absence of the recipient, re-delivery will be at the buyer's expense.

The buyer is obliged to inspect the goods immediately upon receipt. If there is any damage or non-conformity, he is obliged to contact us within 48 hours.

COMPLAINTS AND RETURNS


The buyer has the right to unilaterally terminate the contract without giving any reason within 14 days of receiving the product, in accordance with the Consumer Protection Act. The cost of return is borne by the buyer, and the return is made within 14 days of receiving the returned products.

The right to terminate the contract does not apply to:

  • Products that have been unsealed
  • Personalized products

The buyer is responsible for any reduction in the value of the goods if it is a result of handling that was not necessary to check the properties of the product.

COMPLAINTS


In case of wrongly delivered, damaged or defective product, please contact us at info@pokedom.eu and attach photos and order number. We resolve complaints within 8 working days at the latest.

DATA PROTECTION


All personal data is processed in accordance with the GDPR. Your data is used exclusively for the purposes of order fulfillment, delivery and customer support. Details can be found in our Privacy Policy.

SELLER'S RESPONSIBILITY


The seller takes every measure to ensure that the products on the webshop are displayed accurately, but there may be differences in color, packaging or appearance compared to what is shown. All photos are for informational purposes only.

In case of obvious errors (e.g. price 0 EUR), the Seller reserves the right to cancel the order without legal consequences.

UNILATERAL TERMINATION OF THE CONTRACT


The form for unilateral termination can be found on the webshop page. The return of goods and documentation is done by scanning and sending to the email address: info@pokedom.eu

In case of a return, please contact us via email beforehand.

APPLICABLE LAW AND JURISDICTION


These General Terms and Conditions are subject to the laws of the Republic of Croatia. The Commercial Court in Zagreb is competent for all disputes.
